Duration of Rental
2. The term shall be deemed to be continuous until either party shall give to the other not less than two weeks notice in writing, and the term shall end on that date. The renter agrees to pay the full hire term.

Persons who may tow the vehicle
3. Only the renter named on this contract, with a current and appropriate drivers licence, may tow the vehicle for the duration of the term. The renter accepts responsibility for the suitability and road worthiness of the towing vehicle, and agrees to ensure that it is appropriately equipped to tow the rented vehicle.

Payment by Renter
4. The renter agrees to pay to the supplier all costs in full and on time as listed in this agreement. This includes rent, insurance, bond, and any extra costs incurred for loss, damage, or cleaning. The bond shall be returned to the renter only after the successful completion of this contract as stated.

Method of Payment
5. Shall be as stated in this agreement, at the absolute discretion of the supplier. The renter accepts responsibility for all bank and other charges related to the method of payment, and recovery of any costs or debts pertaining to this agreement.

Cancellation prior to commencement of Rental
6. Deposit paid is non-refundable however it is transferable to another date at the discretion of the supplier.
7. Should the renter fail to take delivery of the booked vehicle on the date specified in this agreement, then it shall be deemed that the booking has been cancelled by default. A cancellation fee may be charged equivalent to two weeks rent as well as the deposit being non-refundable, if the renter fails to notify of changed plans.

Insurance
8. The renter agrees to pay the first $400 of any insurance claim made regarding accidental damage or theft of the rented vehicle or its accessories or spare parts. Any other damage or loss is the liability of the renter, who agrees to pay for any such costs related to the rented vehicle, including vehicle recovery, replacement of vehicle, accessories or spare parts, or loss of income, immediately upon the termination of this contract.

Exclusions
9. The renter shall not be covered by the insurance if any damage, loss, or injury occurs while:
a) The driver of the tow vehicle is under the influence of alcohol or any substance that affects functioning.
b) The renter is under the influence of alcohol or any substance that affects functioning in a responsible way.
c) The vehicle is in an unsafe or unroadworthy condition which arose during the course of the rental term, which contributed to the damage or loss, because the renter was negligent in maintaining the vehicle.
d) The rented vehicle is operated in any race, speed test, or contest.
e) A person not authorised under this contract to do so is towing the rented vehicle.
f) A person is towing the rented vehicle who does not have a valid and appropriate drivers licence.
g) The vehicle is wilfully, carelessly, or recklessly damaged whilst in the care of the renter.
h) The vehicle is used outside the stated terms of rental, without a written extension of term in place.
i) If any claim would be less than $400.
j) The supplier shall not be liable to indemnify the renter or anyone else in respect of any claims for injury inconvenience or damage of any kind, for any reason, regarding the rented vehicle and this contract.

Mechanical repairs and accidents
10. The renter shall not undertake any repairs or salvage without the written consent of the supplier.
Any problems are to be reported immediately, and the vehicle taken off the road until they are fixed.

Renters obligations.
11. To take good care of the rented vehicle and to ensure that no-one tampers with or removes anything.
To ensure that the vehicle and all accessories are maintained in good working order, it is manoeuvred and parked carefully, and securely locked at all times. To immediately report any damage or loss with full details.

Use of the rented vehicle
12. The vehicle shall not be sub-let, used for hire or reward, or used to carry passengers in.
13. The vehicle shall not be used by anyone for any illegal purpose.
14. The vehicle shall be returned by 2pm on the termination date specified, to the place specified on this agreement. Failure to do so without notification will incur a late penalty of two weeks rental equivalent.
